TERMS OF SERVICE FOR SEERS AND ELDERS

Introduction
The Terms Of Service for Seers and Elders is an agreement between you, the applicant ("Seer or Elder"), and Origin Systems, Inc. ("OSI"), that enumerates the rules which govern the role of a volunteer Seer or Elder for OSI’s online game, Ultima Online ("UO" or "the Game"). Upon being accepted to the program, each applicant is required to sign and return a copy of the Terms of Service to OSI, at an address to be specified upon acceptance. No applicant will receive final approval for Seer or Elder status, nor training for that position, nor be assigned special Seer or Elder commands or abilities, until a signed copy of the Terms of Service has been received by OSI.

1. General Responsibilities: The Seer and Elder Programs are volunteer service organizations. Seer or Elder status is a player state, engaged by activating a script on a player character. Seers and Elders design, develop and manage online events, such as quests and plot lines, which may include special characters created especially for the event, activating Non-Player Character spawns of one or more creatures to battle and creating and distributing weapons and other objects to players within the game.

These duties and the manner in which they are handled is covered more fully in the Seer or Elder Rules and Guidelines, a copy of which will be made available to the Seer or Elder after the signed Terms of Service for Seers and Elders is received by OSI. 9/25/99

2. The UO Terms of Service: In addition to these Terms of Service for Seers and Elders, all Seers and Elders are expected to adhere to the UO Subscriber Terms of Service, published online at http://www.uo.com/agreement.html and hereby incorporated into this document.

3. Other Documents and Game Changes: In addition to the Terms of Service and the UO Terms of Service, OSI sometimes modifies or adds to the Terms of Service via the Seer or Elder Rules and Guidelines document, available to you at <<Insert Web Address Here – Not available yet>>. OSI may also note changes to the Game itself, such as new features and modification of statistics or skill gain procedures. Once accepted into the Seer or Elder Program, the Seer or Elder is expected to read these periodically and conform to any changes, additions, and modifications to the Terms of Service for Seers and Elders, and to be familiar with changes in the Game. If the Seer or Elder has any questions about these, he/she is expected to contact their Ancient Seer or Arch-Elder for clarification.

4. Non-Disclosure Agreement: OSI may occasionally choose to give the Seer or Elder certain confidential information so that the Seer or Elder may better perform his/her duties. The Seer or Elder agrees to refrain from discussing any such confidential information with anyone outside of the Seer or Elder Program or OSI’s official Game representatives. OSI will clearly note when such information is confidential, be it verbally transmitted, via online chat, posted on the Seer or Elder Web site, delivered in email, or by any other method.

5. Prerequisites for Being a Seer or Elder: Any current UO player aged 18 years or older and with no outstanding UO billing issues is eligible to apply for the Seer or Elder Program. Applying for the Seer or Elder Program does not guarantee acceptance. OSI reserves the right to grant or deny any such application at its sole discretion.

You may not become a Seer or Elder in any case if:

  • You are under 18 years of age. Proof of age is required prior to commencing training;

  • Work either in-house, under contract, or as a volunteer in any capacity for a computer game company, online games aggregator, or a competing online game product. By signing and returning this form to OSI, you certify that you do not presently work for such a company and/or competitor in any capacity and that, while a member of the Seer or Elder Program, you will immediately inform OSI if you do accept work with such a competitor.

6. Training Course: Because there are new and quite powerful commands and abilities available to Seers and Elders, all applicants for Seer or Elder will be required to take and pass an online training course before being posted for regularly scheduled duty. At present, the training course is expected to take between twelve and twenty-five hours. Scheduling times for the training course will be by arrangement between the Seer or Elder and the person assigned as trainer.

7. Held to a Higher Standard: When on duty, Seers and Elders are considered representatives and "ambassadors at large" for OSI and the Game and, thus, are held to a higher standard of behavior than the average player. Seers and Elders on duty are expected to treat subscribers and other Seers and Elders with dignity, respect, courtesy and professionalism at all times. Seers and Elders who are rude, discourteous, or who behave in any way inappropriately, may be permanently or temporarily dismissed from Seer or Elder duties.

8. Ownership of the Account: Because your account will have access to the special Seer or Elder abilities and commands, you agree that during your involvement in the Seer or Elder program, you will not sell or transfer your game account, nor allow any 3rd Party access to your Seer or Elder character in any manner without the prior written consent of OSI.

9. Termination by OSI: Your affiliation with the Seer or Elder program can be terminated at any time by OSI, for any or no reason and at its sole discretion, with or without advance cause or advance notice.

10. Termination by Seer or Elder: The Seer or Elder is an "at will" commitment and may be terminated by yourself at any time and for any reason, with or without cause or advance notice.

11. Compensation: As a volunteer Seer or Elder, you will not receive or be eligible for any monetary compensation in the form of wages, salary or otherwise for any of the services you perform as a Seer or Elder nor are you eligible for any form of benefits offered by OSI to regular employees. As a volunteer Host, you may receive from time to time complimentary games, game time, game merchandise or otherwise from OSI, at its sole discretion.

12. Leave of Absence: In the event that a Seer or Elder should request a leave of absence from the Seer or Elder program, the Seer or Elder is expected to bring the matter to the attention of the Seer or Elder’s supervisor. If Seer or Elder and supervisor are in agreement, and dependent on the final approval of the Director of Player Relations or designated representative, the Seer or Elder may take a leave of absence of two weeks to four months from his/her regularly scheduled shifts without dropping out of the program altogether.

If a leave of absence can not be agreed to, the Seer or Elder may opt to leave the program entirely, and will be welcome to reapply for the program at a later date.
